Return & Refund Policy
Last updated on 01.04.2026
Welcome to Culmination Manpower Solutions Pvt. Ltd. (“CMS”, “Culmination Manpower”, “we”, “us” or “our”). This Return & Refund Policy explains the circumstances under which refunds, cancellations, payment reversals and related adjustments may be considered for recruitment, manpower, talent acquisition and other services provided by CMS.
As a recruitment and manpower solutions company, our Services are primarily professional and service-based rather than physical products. Accordingly, traditional product return or exchange provisions may not apply to our Services.
This Policy should be read together with our Terms of Use and Privacy & Cookie Policy and applies to payments made directly to CMS for applicable Services.
1. About Our Services
Culmination Manpower Solutions Pvt. Ltd. provides recruitment and human resource solutions to employers and supports candidates in identifying employment opportunities.
Our Services may include, depending on the applicable engagement:
- Talent acquisition services.
- Recruitment and manpower solutions.
- Candidate sourcing.
- Active and passive candidate identification.
- Candidate database and profile search.
- Job vacancy support.
- Direct search and headhunting.
- Candidate referrals and professional networking.
- Candidate screening and preliminary assessment.
- Candidate shortlisting.
- Interview coordination and recruitment support.
- Employer hiring support.
- Recruitment consultancy and related professional services.
The scope, pricing, payment terms, replacement terms and other commercial conditions may vary depending on the particular recruitment assignment or Service agreement.
2. General Refund Principle
Because recruitment and manpower Services involve professional time, candidate sourcing, database searches, screening, communication, coordination and other work, payments may not automatically be refundable once the applicable Service has commenced.
Refund eligibility will depend on the nature of the Service, the stage at which cancellation is requested, the amount of work already completed, the applicable commercial agreement and the circumstances giving rise to the refund request.
Where a separate written agreement, proposal, quotation, invoice or Service arrangement contains specific refund or cancellation terms, those terms may apply to that particular engagement.
3. Employer Recruitment Services
Employers or business clients engaging CMS for recruitment or manpower Services may be required to pay fees according to the applicable commercial arrangement.
Depending on the agreed engagement, charges may relate to recruitment assignments, candidate sourcing, successful hiring, consultancy, manpower support, advertising, specialised search or other Services.
Once CMS has commenced work on a recruitment assignment, the amount already paid may become non-refundable to the extent that professional work, resources or Services have already been provided.
4. Candidate Services
CMS may provide candidates with access to employment opportunities and recruitment assistance as part of our recruitment activities.
Unless a specific paid Service is expressly offered and agreed in writing, submitting a resume, expressing interest in a vacancy, being considered for a position or participating in a recruitment process does not by itself create a right to a refund or compensation.
CMS does not guarantee employment, interview selection, job offers, joining, salary levels or continued employment.
5. No Refund for Unsuccessful Recruitment
A recruitment assignment does not automatically become refundable merely because:
- A candidate is not selected.
- A candidate does not attend an interview.
- A candidate withdraws from consideration.
- An employer changes its hiring requirements.
- An employer decides not to hire.
- A vacancy is placed on hold.
- A position is filled through another source.
- A candidate rejects an offer.
- A candidate does not join after accepting an offer.
- An employer’s internal hiring decision changes.
Where applicable, replacement candidates or other remedies may be provided according to the specific commercial agreement between CMS and the employer.
6. Cancellation Before Service Commencement
If an employer cancels a Service before CMS has commenced substantial work on the applicable assignment, CMS may consider a refund depending on the circumstances.
Any refund may be reduced by amounts relating to work already performed, third-party costs already incurred, advertising or sourcing expenses, administrative costs or other non-recoverable expenses.
Refund decisions will be made based on the applicable engagement terms and the actual status of the Service at the time of cancellation.
7. Cancellation After Service Commencement
Once CMS has commenced recruitment work, including candidate sourcing, profile searches, screening, candidate communication, shortlisting, interview coordination or other substantial activities, fees relating to work already performed may become non-refundable.
Where an assignment is cancelled after work has commenced, CMS may evaluate the amount of work completed and any recoverable or non-recoverable costs before determining whether any refund is appropriate.
8. Cancellation by an Employer
An employer may request cancellation of a recruitment assignment by contacting CMS through the authorised communication channel.
Cancellation requests should clearly identify the relevant recruitment assignment, invoice, payment or Service and provide sufficient information for CMS to review the request.
Cancellation does not automatically create an entitlement to a full refund.
Where work has already been performed, CMS may retain the applicable portion of the payment corresponding to Services already provided or expenses already incurred.
9. Employer Changes to Recruitment Requirements
Recruitment requirements may change during the hiring process.
If an employer changes the job description, location, salary range, qualifications, experience requirements, number of positions or other material recruitment criteria after CMS has commenced work, additional work may be required.
Such changes may not qualify for a refund and may, depending on the applicable commercial arrangement, require revised Service terms or additional fees.
10. Candidate Withdrawal
A candidate may choose to withdraw from a recruitment process at any time.
Candidate withdrawal does not create a refund obligation for CMS where recruitment Services have been provided to an employer or where CMS has already performed work relating to the candidate or vacancy.
Where an employer has a contractual replacement or candidate replacement arrangement with CMS, the applicable terms of that arrangement will govern the situation.
11. Candidate Rejection or Non-Selection
CMS does not guarantee that any candidate will be selected by an employer.
Recruitment decisions may depend on qualifications, experience, interviews, internal employer policies, business requirements, salary expectations, location, availability and other factors determined by the employer.
The rejection or non-selection of a candidate does not by itself create a refund entitlement.
12. Replacement Candidates
Where a specific employer agreement includes a replacement candidate or replacement hiring provision, CMS may provide replacement recruitment support subject to the conditions of that agreement.
A replacement provision, where applicable, may be subject to conditions such as:
- The original placement being covered by a specific replacement arrangement.
- The employer notifying CMS within the applicable period.
- The employer having complied with the agreed payment and commercial terms.
- The vacancy or role remaining substantially similar.
- The reason for replacement being covered by the applicable agreement.
- The employer providing the necessary information regarding the vacancy or candidate’s separation.
Replacement provisions do not automatically constitute a cash refund unless expressly stated in the applicable commercial agreement.
13. No Automatic Refund for Candidate Resignation
Where a candidate leaves employment after joining an employer, any replacement or refund entitlement will depend on the specific recruitment agreement between CMS and the employer.
CMS is not responsible for an employee’s personal decisions, resignation, termination, performance, attendance, conduct or continuation of employment except to the extent expressly agreed under a separate Service arrangement.
14. Duplicate Payments
If an employer or other customer accidentally makes the same payment more than once for the same invoice or Service, the duplicate payment may be reviewed for refund or adjustment.
Requests concerning duplicate payments should be submitted to support@culminationmanpower.com with relevant payment and invoice details.
After verification, CMS may refund the duplicate amount or adjust it against an outstanding or future eligible invoice, where appropriate and mutually agreed.
15. Failed or Unsuccessful Transactions
If a payment is deducted from your bank account, card, UPI account or other payment method but CMS does not receive or successfully record the payment, the transaction may be treated as a failed or pending transaction.
Depending on the payment method and banking system, the amount may be automatically reversed by the relevant bank or payment service provider.
If the amount is not reversed within a reasonable period, you may contact CMS at support@culminationmanpower.com with the transaction details so that we can investigate the matter.
16. Unauthorised or Fraudulent Payments
If you believe that a payment has been made to a person or account falsely claiming to represent CMS, please contact us immediately at support@culminationmanpower.com.
CMS is not responsible for payments voluntarily made by users to unauthorised individuals, fraudulent accounts, unofficial payment channels or third parties who falsely represent themselves as CMS representatives.
Any refund or recovery request relating to an unauthorised payment will be reviewed based on the circumstances and available evidence.
17. Payments Made Through Third-Party Payment Providers
Where payments are processed through a third-party payment gateway, banking platform or other payment service provider, the transaction may also be subject to that provider’s terms, policies and processing procedures.
CMS may rely on payment confirmation received from the relevant payment service provider when determining whether a payment has been successfully received.
Processing times for reversals or refunds may depend partly on the payment provider, banking institution or payment method used.
18. Refund Eligibility
A refund may be considered in circumstances including, but not limited to:
- A verified duplicate payment.
- A verified payment received in error.
- A payment relating to a Service that CMS has agreed in writing to cancel before substantial work commenced.
- A payment that CMS determines should be refunded under the applicable commercial agreement.
- A failed transaction where the amount was successfully received by CMS but the corresponding Service was not activated and the applicable terms provide for reversal.
- Another circumstance where a refund is required under applicable law.
Eligibility for a refund does not necessarily mean that the full amount paid will be refunded.
19. Non-Refundable Services and Costs
Unless expressly stated otherwise in a written agreement, the following may be non-refundable once incurred or performed:
- Recruitment consultancy work already completed.
- Candidate sourcing already performed.
- Candidate database searches.
- Candidate screening and assessment work.
- Candidate shortlisting.
- Interview coordination already completed.
- Direct search or headhunting activities already undertaken.
- Job advertising or promotional costs already incurred.
- Third-party recruitment or technology costs already incurred.
- Administrative or professional work already performed.
- Services delivered in accordance with the applicable engagement.
20. Recruitment Outcome Does Not Determine Refund Eligibility
Recruitment is dependent on multiple factors outside CMS’s complete control.
A recruitment assignment may not result in a successful hire due to factors including employer decisions, candidate availability, candidate expectations, market conditions, changes in job requirements, compensation, location, interview outcomes or other circumstances.
Unless a separate written agreement expressly provides otherwise, unsuccessful recruitment does not automatically create a refund entitlement.
21. Service Quality Concerns
If you believe that CMS has materially failed to provide an agreed Service, please contact us as soon as reasonably possible.
We will review the matter based on the applicable agreement, Service description, communication records and work performed.
Where appropriate, CMS may attempt to resolve a genuine Service issue through correction, additional recruitment support, replacement assistance, Service adjustment or another reasonable remedy.
Any remedy will depend on the nature of the Service and the applicable commercial terms.
22. How to Request a Refund
All refund requests should be submitted by email to:
Email: support@culminationmanpower.com
To help us process your request, please provide:
- Your name or organisation name.
- Relevant contact information.
- Invoice or reference number, if available.
- Payment date.
- Amount paid.
- Payment method.
- Relevant recruitment assignment or Service.
- Reason for requesting the refund.
- Supporting transaction or payment information where applicable.
CMS may request additional information or documentation where reasonably necessary to verify the request.
23. Refund Review Process
After receiving a refund request, CMS may review:
- The applicable Service agreement.
- Invoice and payment records.
- The status of the recruitment assignment.
- The Services already provided.
- Work already performed by recruitment consultants.
- Third-party or administrative costs already incurred.
- The reason for cancellation or refund.
- Applicable replacement or refund provisions.
- Any relevant communications between the parties.
Refund decisions will be communicated after reasonable review of the relevant circumstances.
24. Refund Processing Time
Where a refund has been approved, CMS will generally initiate the refund through the appropriate payment method or agreed payment channel.
The time required for the refunded amount to appear in the customer’s bank account or payment instrument may depend on the payment gateway, bank, card issuer, UPI provider or other financial institution.
CMS does not control the internal processing timelines of third-party financial institutions.
25. Refund Method
Where practical, approved refunds will generally be processed using the original payment method or another mutually agreed method.
For security and compliance reasons, CMS may request verification before processing a refund.
CMS may decline to process a refund to a third party where the identity or authority of the recipient cannot be reasonably verified.
26. Partial Refunds
In certain circumstances, CMS may approve a partial refund rather than a full refund.
A partial refund may be appropriate where:
- Part of the Service has already been completed.
- Professional work has already been performed.
- Third-party costs have already been incurred.
- Some components of the Service remain unused.
- The applicable agreement provides for a partial refund.
27. Refunds and Taxes
Where applicable, refunds and adjustments may be subject to the treatment required under applicable tax laws and accounting requirements.
Where taxes have already been deposited, reported or otherwise become subject to statutory requirements, CMS may process the refund or adjustment in accordance with applicable law.
28. Chargebacks and Payment Disputes
Customers are encouraged to contact CMS before initiating a payment dispute or chargeback where a genuine billing or Service issue exists.
If a chargeback is initiated, CMS may provide relevant transaction records, invoices, Service details and communication records to the applicable payment provider or financial institution as reasonably necessary to respond to the dispute.
Unauthorised or abusive chargebacks may be treated as a violation of the applicable Service terms.
29. Cancellation of a Recruitment Assignment
An employer requesting cancellation should notify CMS as soon as reasonably possible.
The financial consequences of cancellation will depend on the stage of the assignment and the applicable commercial terms.
Early cancellation may not eliminate amounts already earned or costs already incurred by CMS.
30. Employer Failure to Provide Required Information
Recruitment Services may depend on timely and accurate information from an employer.
If an employer fails to provide necessary job descriptions, candidate criteria, interview availability, feedback or other information required to perform the Service, delays or unsuccessful outcomes may occur.
Such circumstances do not automatically create a refund entitlement where CMS has otherwise performed its agreed responsibilities.
31. Candidate Failure to Provide Information
Candidates are responsible for providing accurate information and responding appropriately to recruitment communications.
Failure to provide requested information, attend scheduled interviews, respond to communications or complete recruitment requirements may affect the recruitment process.
Such circumstances do not create an automatic refund entitlement for any applicable paid Service.
32. No Physical Product Returns
CMS primarily provides professional recruitment, manpower and talent acquisition Services. We do not generally sell physical products through our Website.
Accordingly, conventional product return, exchange or physical product replacement provisions do not ordinarily apply to our Services.
33. Exceptions
CMS may consider exceptions to this Policy in exceptional circumstances, including where required by applicable law, where a clear administrative error has occurred, or where CMS determines that an exception is appropriate based on the specific circumstances.
Any exception granted in one situation does not create a continuing obligation to provide the same exception in another situation.
34. Legal Rights
Nothing in this Policy is intended to remove, restrict or limit any consumer, contractual or statutory right that cannot legally be excluded or restricted under applicable law.
Where applicable law provides a mandatory right to a refund, cancellation or other remedy, that right will continue to apply.
35. Changes to This Refund Policy
CMS may modify this Return & Refund Policy from time to time to reflect changes in our Services, commercial practices, payment systems, legal requirements or business operations.
The revised version will be published on our Website with the applicable effective or updated date.
Users are encouraged to review this Policy periodically before purchasing or engaging with any paid Service.
